we post most of our land  when we do it is name,town,date, address and phone #  most signs do not have a name on them is that legal?

 Pretty sure the proclamation says they must display the name of the owner in LEGIBLE print, visible from outside the property boundaries, at least every 880 yards OR at EVERY gate if the property is fenced.

I pretty much dont hunt even if it is a old tire that says no hunting if i dont know the area or owner. not worth getting people all bent out of shape.

Forget what the proclamation says for a bit.  The NDCC is clear.  If it is land (not a building site or home), a sign must include the NAME of the person posting the property.  I don't know of any States Attorneys who would prosecute if there was no name on the sign.  FYI, the sign could be a tire hung on a post.

long storry short a buddy i USED to hunt with was always trying to push technicalitys. i cought up with him a year ago and in conversation i discovered he had walked some ilealy posted land that fall and the owner took his liscence plate down and called g&f. he got a call that night from the warden and im not so many words said he will be sorry if he hunts any more posted land in his district.

also why are there so many legality discussions on this site? would it not be easyer to just call a warden and ask? you are already on the net. www.gf.nd.gov the numbers are all listed

The simple answer to your question is that you are providing much more information than the law requires for protection against criminal trespass and even more information than Game and Fish requires on signs.  The information you are posting is appreciated by hunters because it provides help in attempting to gain access.

For criminal trespass, a sign must indicate that trespassing is forbidden, it must list the name of the person doing the posting, and it must be where it could be reasonably seen by a person entering the property.

Game and Fish adds some specific requirements about distance between signs and how to post land enclosed by a fence.

Land could be legally posted under State Law but not meet the requirements set in the Proclamation.  That MIGHT get somebody out of a ticket from a Warden but wouldn't protect them from Prosecution by the States Attorney if a complaint was filed.

I know the law quite well on this subject but I consider a sign to be enough.  Name or not.  Usually, I'd rather have talked to the landowner even if there isn't a sign.  Maybe that's just me but an argument with somebody pretty much ruins the day.  Why chance it?

Legal or illegal isn't it immoral or just not right to be hunting land that is posted? Why look for excuses! If it's posted in any form or fashion do your homework contact the owner and get permission. It's really that simple!!!

The guy who started the thread is doing the posting.  He wants to know if he's doing it right.  I'd consider that a legit question.

Farnorth said it best. There are two sections of ND law that apply to trespassing. The 12.1-22-03 code for criminal trespass and the 20 code for the Game and Fish.

you are spot on. if you can afford the posted sign, you can afford the sharpie to write your name on it with. personally, if i was fortunate enough to be a landowner, i would be damn proud to have my name on that poster.

and as far as how many, well, i would put one up every 1/8 mile. if you don't want people out there, get the point across. now, i guess if you had like 20 sections of land to post, that would be a major pain. but if you don't want people out there, why not do it right.

hey guys what do you think  we farm around 50 quarters of land and i do let alot of hunters in some of our land is 30 pluss miles fromhome base. was wondering what you think of ideas of how we can understand the area a guy calls and wants to hunt with the gps now adays the give us street number well to be honest i have no clue what street what is on except my house. so should i put a number system on posters so when they call they can give number then i can look it up or by the name of such peace of land or maybe one of you have and idea...............not looking to start a fight just ideas
